Aquatic facilities

Some aquatic facilities need to be registered with local Government. In line with the Public Health and Wellbeing Regulation 2019, all category 1 aquatic facilities within Mitchell Shire will need to complete the Aquatic Facilities Registration Form.

Category 2 aquatic facilities don’t need a formal registration, but council still needs to be notified via the Aquatic Facilities Registration Form.

Please note that all public aquatic facilities must have a Water Quality Risk Management Plan, which will be required to complete the registration form. Category 1 facilities

A category 1 aquatic facility is a swimming pool, spa pool or interactive water feature that meets one or more of the following criteria:

  • is used by members of the public, whether free of charge or on payment of a fee
  • is used in association with a class or program that is offered free of charge or on payment of a fee
  • is located at the premises of an early childhood service, school or other educational institution
  • is located at premises at which residential aged care services are provided
  • is located at any of the following premises:
    • a public hospital
    • a multi purpose service
    • a denominational hospital
    • a private hospital
    • a privately-operated hospital within the meaning of section 3(1) of the Health Services Act 1988.

Category 2 facilities

A category 2 aquatic facility is a swimming pool or spa pool that is used by members of the public and located at the premises of one of the following:

  • a residential apartment complex
  • a hotel, motel or hostel.

Category 2 aquatic facilities are not required to be registered with the council, however Council must still be notified of their existence. It is the responsibility of the aquatic facility operator to ensure that standards and requirements are complied with.

Exempt aquatic facilities

The following are defined as exempt aquatic facilities that do not need registration:

  • a spa pool that is, or is intended to be, emptied of water after each use
  • a flotation tank
  • a spring water pool that has a turnover rate of at least 25 percent of the entire volume of the water in the pool to waste each hour
  • a waterway within the meaning of section 3(1) of the Water Act 1989 (external link).
  • a private dam within the meaning of section 3(1) of the Water Act 1989 (external link).

Checking Water Quality – Swimming Pools and Spas

We collect and analyse water from public pools to ensure it meets the standards, as required by the Health and Wellbeing Act 2008.

The testing is conducted at random, two times a year by an authorised council officer.
