Public Notice - Proposed Declaration of Public Highway – Part Wandong Avenue Wandong

Mitchell Shire Council is aware of concerns and uncertainty around the legal status and management of land on both sides of the section of Wandong Avenue adjacent to Rail Street. The whole of the land in question, including the constructed road, is shown hatched on the plan below. Parts of the area shown hatched include land used for both vehicle and pedestrian passage and it is anticipated that the balance of the land will be required in the future for road expansion and improvements and for pedestrian infrastructure.

In order to clarify its legal status, Mitchell Shire Council (Council) gives notice that it proposes to declare the area shown hatched on the plan below as a public highway, Wandong Avenue, in accordance with section 204 of the Local Government Act 1989.

Any person who wishes to make a submission regarding the proposal may do so under Section 223 of the Local Government Act 1989 (the Act). Written submissions in relation to this Notice will be considered in accordance with Section 223 of the Act. Please note all written submissions lodged will be available for public inspection for a period of 12 months in accordance with the Act. Any person making a written submission may request in the submission to be heard in support of their written submission. Any person requesting to be heard is entitled to appear in person, or be represented by a person specified in the submission, before a meeting of Council’s Community Questions and Hearings Committee.
